Sicherheit nach § 650g BGB (§ 648a BGB a.F.) universell verwendbar  

Das Sicherungsverlangen des Unternehmers nach § 648a Abs. 1 BGB (§ 650g BGB n.F.) bietet nicht nur eine oftmals durchaus geeignete Sicherheit für den Auftragnehmer, sondern kann auch die Grundlage für die Kündigung eines unliebsam gewordenen Vertrages bilden. Sie ist zudem, wie der Bundesgerichtshof in seinem aktuellen Urteil vom 30.11.2017 – VII ZR 34/15 – entschieden hat, auch als Druckmittel für Vertragsverhandlungen geeignet. Dem Sicherungsverlangen könnten, so der BGH, auch andere Motive als die bloße Erlangung einer Sicherheitsurkunde liegen. Hierin sei jedenfalls keine unzulässige Rechtsausübung zu sehen.
