Wirtschaftsstrafrecht – Zur strafbaren Veranstaltung eines Glücksspiels

Die unerlaubte Veranstaltung eines Glücksspiels wird nach § 284 StGB unter bestimmten Voraussetzungen unter Strafe gestellt. Dabei ist der objektive Tatbestand des § 284 StGB, neben dem Erfordernis des Vorliegens eines Glücksspiels, bereits dann erfüllt, wenn für das konkret aufgestellte Gerät keine Bauartzulassung der Physikalisch-technischen Bundesanstalt (PTB) besteht oder das in Rede stehende Gerät abweichend von dieser Zulassung betrieben wird. Einer darüber hinausgehenden Prüfung, ob eine insoweit manipulierte Software auch den Voraussetzungen des § 13 SpielV genügt, bedarf es, nach einem Beschluss des Bundesgerichtshofes vom 17. Januar 2018 (Az. 4 StR 305/17), dagegen nicht.
