Nachtarbeit und Mindestlohn – tarifliche Zuschläge sind „on top“ zu zahlen

Das BAG hat mit Urteil vom 20.09.2017 – 10 AZR 171/16 – entschieden, dass sich die Höhe der Entgeltfortzahlung an Feiertagen nach § 2 EFZG i.V.m. § 1 MiLoG richtet, sofern kein höherer tariflicher oder vertraglicher Vergütungsanspruch besteht. Ein Rückgriff des Arbeitgebers auf eine vertraglich vereinbarte niedrigere Vergütung zur Berechnung  von tariflichen Nachtarbeitszuschlag sowie dem tariflichen Urlaubsentgelt scheidet somit aus.
